Terri Schiavo … finnally

WASHINGTON (CNN) — Terri Schiavo, the 41-year-old brain-damaged woman who became the centerpiece of a national right-to-die battle, died Thursday morning, nearly two weeks after doctors removed the feeding tube that had sustained her for more than a decade.

Brother Paul O’Donnell, a spokesman for Bob and Mary Schindler, Schiavo’s parents, said the couple was with their daughter’s body and praying.

Wednesday, the Schindlers lost what their lawyer described as their “last meaningful legal appeal” in their desperate battle to have their brain-damaged daughter’s feeding tube reinserted.

The U.S. Supreme Court late Wednesday refused once again to hear an emergency appeal from the Schindlers.

Their lawyer, David Gibbs, heard the high court had rejected the appeal during a news conference outside the Pinellas Park, Florida, hospice where Schiavo was receiving care.

“It appears that that will be the last meaningful legal appeal unless something comes up,” Gibbs had said. “Fundamentally, the decision of the Florida courts will remain unchanged and the federal courts have declined to get involved.”

Thursday morning, O’ Donnell said that Schiavo was in her final hours of life, and police have prohibited her blood relatives from spending time with her.

O’Donnell, one of the family’s spiritual advisers, said that her parents and siblings were “begging to be at her bedside…but are being denied.”

Michael Schiavo was Terri’s guardian and controlled who may visit her and when.

Pasco-Pinellas Circuit Judge George Greer in Clearwater, Florida, ordered the feeding tube removed March 18 at Michael Schiavo’s request. He has said that his wife wouldn’t have wanted to live in her condition — what Florida courts have deemed a “persistent vegetative state.”

The parents felt otherwise and had sought to take guardianship of their daughter from her husband. Their bitter court battles began in 1998.

“I don’t understand why Michael Schiavo at some point didn’t walk away,” Gibbs said.

Justice Anthony Kennedy, who has jurisdiction over Florida, Georgia and Alabama, and could have ruled on the petition on his own, referred the appeal to the entire Supreme Court at 10:40 p.m. Wednesday.

There was no breakdown of the vote, and the high court issued no explanation for its decision. The petition had been filed earlier in the night.

It was the second time in a week the high court refused to hear the case, and the sixth time since 2001.

The Schindlers “can know they have done everything possible under the law in letting government know that they wanted to fight for the life of their daughter,” Gibbs said.

In his Supreme Court filing, Gibbs and other lawyers for the parents wrote that removing the tube represented “an unconstitutional deprivation of Terri Schiavo’s constitutional right to life.”

The Supreme Court’s rejection came hours after the 11th U.S. Circuit Court of Appeals in Atlanta, Georgia, rejected the parents’ petition 9-2. That court denied three similar requests from the parents last week.

In a concurring opinion of the Atlanta court’s latest ruling, Judge Stanley Birch said Congress “chose to overstep constitutional boundaries” by passing a law to force the Schiavo case into federal courts.

Judges Gerald Tjoflat and Charles Wilson dissented, with Tjoflat writing that the Schindlers deserved a hearing on the merits of their argument.

On March 21, three days after Schiavo’s feeding tube was removed, Congress passed a bill transferring jurisdiction of the case from Florida state court to a U.S. District Court, for a federal judge to review. President Bush signed it into law the next day. But federal courts refused to overturn the state courts’ decision.

Organs falling out…

Police investigate after organs discovered on sidewalk

NEW HAVEN, Conn. — Police are investigating the discovery of what they believe are human organs found on the sidewalk not far from Yale-New Haven Hospital.

Someone called police Wednesday evening to report they had found a liver and a kidney on the sidewalk.

Police believe they are human organs but have not yet confirmed that. Nor do they know where the organs came from.

Hospital officials said they had not misplaced any organs, and no one showed up at the emergency room without theirs. Any organs intended for transplant would have been tightly sealed in a container.

Officials say the organs could have come from the Yale anatomy lab, which is around the corner from where the organs were found.

Free Flatpanel? Whatever you must be kidding

The same companies that do the free ipod, mini-ipod, mini apple are doing a free flat panel. Now a lot of you, including me have said its a crock of shit. I have been proven wrong by several bloggers that I link to from this site when they recieved their ipods in the mail. It just took forever.

    New Artist… again

    Ok, so now we’re on the 3rd artist, the two prior disapeared without a trace. This one is eager to help me with the redesign and has reasonable pricing. With any luck the site will have a new look in the next couple of weeks.

    A Remembrance of Things Forgotten:

    We all forget things, but it seems more and more we forget the things that are most important to us. In the last few weeks of the Terri Schivo ordeal, I have remembered who we are as a people. We are fighters, we are warriors of justice, to put it another way, we are heroes.

    Terri Schiavo: Last hours

    CNN reports that shes almost gone. Since the entire case is about money we’ve come up with an idea that the parents should have thought of.

    A time of death pool for Terri. They could mount a camera in her room and broadcast it to the web and post odds out in Vegas.

    Now don’t get all high and mighty and say “oh my god I can’t believe you said that.” You know that you most likely thought at some point “I bet she’ll die tomorrow.”

    I did not want to get out of bed this morning, but alas I did. Hell it is “Good” Friday. Well it would have been a “Great” Friday, if all of our Team members were here.

    We have a member of our “team” that we will call “BS”, and yes we can also refer to him as “Bullshit”. This individual thinks that it is perfectly fine to call in sick on Mondays and Fridays on a regular basis. He also seems to think that it is fine to run his second business while he is here at work. And he also thinks it is fine to harass other fellow employees.

    But alas, he is still working here at company “X”. Yes it boggles my mind how someone can stay in such good graces with upper management.

    I just personally feel that this guy completely kills the moral in this department.

    I know any where else this guy would have been shit canned a long long time ago.

    Terri Schiavo Update

    CNN is reporting that the presiding Judge in the ungoing legal battle between Terri Schiavo’s parents and her husband has ruled that the feeding tube was to be pulled today as scheduled. Fox News is reporting that this has now taken place.

    The core issue here is whether or not Michael Schiavo has the authority to dictate his incapaciated wife’s care based upon the contract/covenant he and his wife agreed to when they married. Can he say what her wishes were even though they were not written out, based upon their marriage agreement? Further, do his rights as her husband to dictate her care supercede the rights of her parents? Which tie is stronger in the eyes of the government?

    I have my own beliefs on this issue, naturally. Deciding whether or not to end a life that has so very little chance of regaining the capacity to care for itself is a decision I have some experience with. Fortunately, at that time the person in question regained some ability within a few months. However, this has been fourteen years. Terri Schiavo has little to no chance of ever regaining any ability to function on her own, based on the medical experts who have cared for her. Further, even though there are always extenuating circumstances in amtters such as these I have to believe that Michael Schiavo is acting in what he feels is in the best interests of his wife. Were that not the case, I would find it hard to believe that he would have remained married to her.

    Since we last brought up this issue on Wetwired several individuals have come forward and offered Michael Schiavo from one to ten million dollars to divorce his wife and leave her care in the hands of her parents. He has refused all offers- so obviously, he isn’t in this for the money.

    This is also exacerbated by the fact that the two opposing parties in this case have a level of animosity for each other that few could fathom. I mean, the parents of Terri hate- HATE- Michael Schiavo. They truly cannot stand the man.

    Speaking of the parents, I sympathize for them. I truly do. However, they have made a very large mistake in believing that their daughter is still alive. The woman that was Terri Schiavo died fifteen years ago. What sits there in that bed, or in the video that we see on news sites and networks?

    That’s not Terri Schiavo. Trust me.

    It is however the last remaining tie to their daughter that these two people have, and instead of letting go and letting this husk of a former life cease to be, they have prolonged the agony of what remains of their daughter.

    It disturbs me that like so many other things in society this has become a poilitical issue as well. There is absolutely no need for the House of Representatives to subpoena those involved in this, nor is there a need to any federal statute to extend this ordeal.

    I know that this site has a limited readership, and I know that Bob and Mary Schindler are not going to read this most likely. If somehow this gets to them through some means, then I have one message for them.

    Let her go. If you ever want to have peace in your life, let her go. Maybe then, you can begin to heal the pain that you have gone through for so long.

    The Transporter and Madeleines


    I came across Cooking with Amy by chance when I was looking at the links on blogger on the dashboard. Now cooking sites are a dime a douzen so to speak, but what drew me to her site to actually read a bit was the picture of Madeleines. I have actually never had them but her description only makes me want to try them more.

    Since the 18th Century madeleines have been associated with the French town of Commercy. There was once a local convent in Commercy dedicated to St. Mary Magdelen, so that could be where the name comes from. Historians hypothesize that nuns sold their recipe to the bakers of the town when convents were abolished during the French Revolution. Yet another story says madeleines were invented during a feast given in Commercy by a young servant named Madeleine. The Dutch carried them on a pilgrimage to Spain in the 1700’s (the shape was the symbol of the pilgrimage). Going back almost another 100 years, there are also various accounts of cakes being baked in aspic pans to test out the batter. The definitive origin of the madeleine remains a mystery.

    I recently got a chance to try several kinds and brands of madeleines and I was particularly impressed with one in particular that is made here in the Bay Area–Donsuemor Madeleines.. The company prides itself on using all natural ingredients and no preservatives, but trying to learn more about the butter they used was a trade secret I could not get anyone to part with. Is it European butter? Domestic butter? Another mystery. The only thing I know for sure is the taste of butter, and it’s in there.

    You can find Donsuemor Madeleines at Trader Joe’s, Peet’s Coffee & Tea and at a large coffee chain with a mermaid for a logo. They are available in the traditional style, lemon flavored or chocolate dipped. Next year is the company’s 30th anniversary and they expect to roll out one more flavor. In France madeleines come in many flavors–chocolate, spiced and even orange flower water so I’m guessing it might be one of those.

    Whatever madeleine you choose, make sure it’s tender and fresh, it should never be hard. Donsuemor actually recommends refreshing them in the oven which is not a bad idea. Eating a fresh madeleine you can enjoy what Donsuemor describes as the “madeleine moment”. It’s kind of like those old TV ads for Calgon where the harried housefrau would say “Calgon, take me away!” and suddenly there was a vision of a bathtub filled with bubbles and soft music in the background. Without getting naked, eating a madeleine can transport you. Just ask Proust.

    Now if you remeber the movie the Transporter, one of my favorite action flics, you might remeber the hot Chinese (Taiwanese porn star actually) star who cooks Madeleines for Jason Statham and the French detective who recounts about how he had them when he was a boy. If you were interested the movie was directed by Luc Besson who also had the hits, The Professional and The Fifth Element. Needless to say if you liked those flics you’ll love the Transporter, and while your watching that pay attention for the scene with the Madeleines.
